Welcome to the Terms of Service page for Oceanusis (Ocean, They/Their/Theirs). These terms outline the mutual responsibilities, expectations, and policies that ensure a smooth and professional collaboration. By engaging in their video editing services, you are agreeing that you have read, understood, and agreed to the guidelines outlined below. Please review each section carefully to ensure a clear understanding of all guidelines. Your satisfaction and trust are top priority, so if you have any questions regarding any of the guidelines, don't be afraid to ask.

1. Scope of Services

Ocean provides professional video editing services, including but not limited to; color grading, captioning, motion graphics, simple cutting, splicing, transitions, special effects, sound design, and audio synchronization. Specific services or project styles will be agreed upon prior to the commencement of work.

2. Payment Terms

2.1 Pricing includes the total sum of all requested project files plus any additional fees tacked on by the client's choice of payment method. All project-specific pricing will be agreed upon prior to the commencement of said project. Pricing will vary depending on the length or intensity of the project. A detailed invoice for each project will be provided to the client via Email, Discord, or other approved means of communication.
2.2 Payment Scheduling A deposit of 45% may be required upfront for new clients, with the remaining balance due upon project completion unless stated otherwise and agreed upon by Ocean. A payment schedule or plan must be agreed upon in writing via Email, Discord, or other approved means of communication.
2.3 Late/Insufficient Payments All late or insufficient payments will be subject to late fees and/or legal action depending on the severity of the circumstances.

3. Cancellation Policy

3.1 Refunds Clients may cancel projects at any point, however any initial deposits will not be refunded if the project has commenced.
3.2 Proof of Cancellation All cancellations must be communicated in writing via Email, Discord, or other approved means of communication.

4. Intellectual Property

4.1 Raw Footage The client retains ownership of the raw footage provided to Ocean.
4.2 Edited Footage Final edited content becomes the intellectual property of the client upon receipt of full payment. Ocean retains the rights to use all completed projects in their portfolio unless explicitly prohibited by the client. All prohibitions must be communicated in writing via Email, Discord, or other approved means of communication.

5. Revision Policy

5.1 Revision Timing Revision requests must be submitted within 2 days of receiving the draft. Revision requests submitted past that time period will not be considered.
5.2 Revision Pricing 2 rounds of simple revisions are included in the initial project fee. Additional revisions will be billed per revision at 5% - 10% of the initial project rate depending on the complexity of each revision.

6. Attribution and Credits

6.1 Recognition of Editing All projects edited by Ocean must include explicit recognition of Ocean's contributions. Attributions must be placed in an end credits sequence or within a description field on the specified digital platform.
6.2 Placement and Format Attributions must be displayed as "Edited By: (Ocean's website link)" or an agreed-upon equivalent. The format, visibility, and placement of the credit must be clear, legible, and consistent with industry standards.
6.3 Omissions or Modifications Any request to omit or modify an attribution must be discussed via Email or other approved form of communication and agreed upon. Any omissions or modifications to an attribution without prior agreement may result in services being terminated.

7. Discrimination Policy

Ocean does not tolerate discrimination in any form, including but not limited to, gender identity, sexual orientation, or any other characteristic protected by applicable law.Clients are expected to conduct themselves with respect in every interaction. Inappropriate or discriminatory behavior will result in the termination of services without refund.

please message me on any of my platforms with any details of what you would like for a price quote. the base price is appropriate for the most basic of logo designs and is non-negotiable.logo design prices will vary greatly. please understand that the price reflects the logo's usage as well as its complexity. logos can and will be used for many things - merchandise design, packaging design, social media posts/profiles, etc. you are essentially paying for your rights to use your logo for whatever you see fit.

personal designs are designs that are for personal use only, while commercial designs are designs that you can use on your own merch for profit.the base price for personal designs refers to the cut of my profit that is taken by the print-on-demand site in order to manufacture the merchandise.please understand that the price window of both the commercial and personal designs reflects the design's usage as well as its complexity. for commercial designs, you are essentially paying for your right to use your design for your own financial gain.

design phases

by commissioning me, you agree that you have read, understand, and will respect all of the design phases outlined below.

something to remember: my timezone is EST. please clarify your timezone when you message me so that we can discuss a convenient time for both of us to hold conversations throughout the entire process.

phase 1: upfront costs and commission details

during this phase I'll be asking you all about what you'd like me to design for you. these are just a few of the key things I will usually request:

character/emote/chibi designs:

  • your email address for receiving your design

  • references of your character if you have any

  • references for the pose you would like

  • references for your preferred art style if one other than my own is requested

logo designs:

  • your email address for receiving your design

  • if the logo represents your business, explain your brand to me, especially the aesthetic and what your brand specializes in

  • references of other logos you would like for me to replicate the style of if you have any

  • whether or not you would like multiple variations of your logo

  • color references for your logo

merch designs:

  • your email address for receiving your design

  • whether or not your merchandise design will be for personal or commercial use

  • what type of merchandise you're considering using the design for (coffee mugs, t-shirts, posters, etc.)

  • references of other merchandise designs that you would like for me to keep in mind while designing your merchandise

  • whether or not you would like multiple variations of your merchandise design

  • color references for your merchandise design

  • if your design is for personal use, which print-on-demand site you would prefer me use if you're opposed to using Teespring

I take 75% of the cost upfront before any phase of the commission is complete. all transactions are completed through PayPal. I take a percentage to cover the time it takes for me to sketch out your design. this percentage is non-refundable and non-negotiable. please understand that the reason why I do this is to avoid theft of my work and to avoid wasting my time with someone that doesn't want to pay me once their design is finished.once you have paid the upfront cost, your commission slot is then secured. commission slots are first come first served.

phase 2: sketching

after the payment is processed, I will begin the sketching phase. you'll receive constant updates throughout this phase. I will only do 3 major revisions free of charge throughout this process (ex. changing the pose of the character, changing a major portion of the design, etc.). each additional major revision will be $5 per revision and will be calculated into the remaining 25% of the payment that I'll take once the sketching process is completed.

phase 3: rendering

after you've approved the sketch, the rendering process will begin. during the rendering process, I will send you constant updates regarding the line work, colors, shading, and lighting. I do not charge extra for revisions during this phase, but I do ask that you keep any revisions to a minimum. I will not do any major revisions during the rendering phase.

phase 4: receiving

after phase 3 is complete, you will receive your design files through the email that you provided for me in phase 1. once you have received your design, I will no longer make any free adjustments to your design. any pricing for minor future adjustments may be negotiated if they are requested.

terms & conditions

by commissioning me, you agree to accept all terms and conditions outlined below.

I accept all payments through PayPal, CashApp, or Venmo and I only accept payments in USD. if something happens during the transaction process and I do not receive your payment or you can't complete the transaction, it is your responsibility to contact the support team of the payment app you used and get the issue resolved.I will dispute all false chargebacks or disputes opened in any of the payment apps listed above. if you open up a false dispute or if you do a false chargeback, you will also be blacklisted immediately.please do not pay me before we discuss the details of the commission. all commissions are final once paid for. I will not offer refunds for any transaction that takes place. please ensure that you are ready to commission me before beginning the process.I will not design political propaganda, homophobic, transphobic, or racist content. I will not design anything that depicts the death or harm of a public figure or someone else. I will not design any NSFW of characters that are minors or that present as underage. the boundaries of any NSFW designs may be discussed between us privately.my artwork is not to be used for NFTs or anything of the sort. you are not to use my designs for commercial use unless you are given explicit permission by me to do so. if I find that you have been using my artwork for your commercial use and you have not received permission from me to do so, I will cut all contact with you immediately and any ongoing commissions will be voided without any chance of a refund. legal action will be taken depending on the severity of the situation.you are not to use my artwork for anything that would be considered defamatory. if I find that you have been using your commissioned artwork to slander me, I will cut all contact with you immediately and any ongoing commissions will be voided without any chance of a refund.by beginning the commission process with me, you agree to give me 5 to 10 business days to begin phase 2. if I have not started phase 2 once this time period has passed, you may request a refund and I will refund you. my turnaround time varies greatly depending on the complexity of the project. if you are concerned about meeting a certain deadline or have any questions regarding the turnaround time for your design, please feel free to ask any questions. I can not work under extremely strict deadlines.personal merchandise designs will not be provided for you through your email, instead they will be posted on Teespring or another trusted print-on-demand site of your choosing for you to purchase the merchandise that you commissioned the design for. please understand this before commissioning me for personal merchandise designs. please understand that the base price for merchandise refers to the cut of profit that the print-on-demand site deducts from my earnings in order to produce the merchandise. the base price for each product you commission a design for will be added to the cost of the design regardless of which print-on-demand site you choose to purchase the merchandise from. if you would prefer to purchase your personal merchandise through a site other than Teespring, please become familiar with the base prices of each print-on-demand site before recommending a site other than Teespring. personal designs are not to be used for your own profit in any way.If I offer you a refund for whatever reason, I am not responsible for the fees that any payment apps may deduct from your refund.
